Öz
Tıbbi uygulama hatası iddiası ile karşılaşıldığı zaman “illiyet varlığının” tespitinin yapılması büyük sorun teşkil etmektedir. Araya giren başka faktörlerin ortaya çıkan istenmeyen duruma etkisi illiyet tespitinde büyük zorluk çıkarmaktadır. Bu durumlarda, hukuki ve felsefi perspektifle hazırlanmış olan illiyet testlerinin uygulanması faydalı olabilmektedir. Bu yazıda, bu testlerin en yaygın bilinen ve kullanılanı “but for” testi ile daha az bilinen ve daha nadir kullanılan “substantial factor” testi ve “INUS/NESS” testlerinin kullanımına dair bilgiler literatürden derlenmiş, tıbbi uygulama hatalarında kullanımı olgularla açıklanmıştır.
